Marital Property
Texas recognizes two types of property: community property and separate property. Property acquired during a marriage is presumed to be community property and property acquired prior to marriage or acquired by gift, devise, or descent is presumed to be separate property. However, all property owned at the time of a divorce filing is presumed to be community property and a person wishing to claim property as separate property must prove it as such with "clear and convincing" evidence.
